What Is the FDA Actually Changing?

The FDA's new direction signals a shift toward establishing allergen threshold levels, which would set specific concentration limits for how much of an allergen can be present before it poses a meaningful risk. This approach would be more expressly risk-based, emphasizing validated cross-contact controls and reference doses rather than relying solely on ingredient disclosure and voluntary warnings.

Why Are Allergen Thresholds So Important for Food Safety?

Nearly 1,800 people registered for the FDA's February 2026 listening sessions, with approximately 130 speakers participating, including industry representatives, consumer advocacy groups, academics, and healthcare professionals. The broad consensus among stakeholders was that a harmonized, risk-based threshold framework would help reduce inconsistent labeling, consumer confusion, and unnecessarily restricted food choices for people with allergies.

One key insight from the sessions: participants agreed that thresholds are most effective when applied to validate preventive controls, particularly sanitation and cleaning procedures on shared equipment, rather than relying on routine finished product testing. This makes sense because allergen cross-contact is non-uniform, and sampling can easily miss small particles or clumps. Participants also emphasized that any future threshold framework must translate clinical reference doses into practical concentration limits that manufacturers can actually implement and verify.

How to Prepare for Upcoming Allergen Labeling Changes

The FDA's separate gluten initiative is also moving forward, seeking information on labeling and preventing cross-contact of gluten in packaged foods, with specific attention to rye, barley, and oats. At the state level, California's SB 68, which took effect July 1, 2026, requires covered food facilities to provide written notification of major food allergens in menu items. New York has also enacted allergen labeling requirements for certain prepackaged foods, effective November 2026.

In Congress, two bills reflect growing attention to allergen and food labeling transparency: H.R. 9048, the Celiac Safety Act of 2026, would amend federal law to include gluten-containing grains in the definition of "major food allergen," while H.R. 8385, the Food Labeling Modernization Act of 2026, addresses broader nutrient and front-of-package labeling.

For now, companies must still comply with existing binding obligations: major food allergen labeling requirements, truthful and non-misleading labels, and adequate cGMP and preventive control programs to prevent or significantly minimize allergen cross-contact. However, the practical reality is shifting. Allergen compliance may increasingly depend not just on what the label says, but on whether a company can substantiate the risk through validated controls and documented evidence. The plaintiffs' bar is already active in allergen and food labeling disputes, making this an area where regulatory change and litigation risk converge.
